1. Acceptance of Terms
By downloading, installing, or using the No Gout mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms are a legal agreement between you and COZYGRAIL LLC ("we," "us," or "our").
2. Description of Service
No Gout provides tools to help users track and understand their dietary purine intake, including:
- AI-powered food scanning and purine content estimation
- Daily and weekly gout risk scoring
- Virtual foot health visualization
- Gout flare logging
- Community discussion features
All information provided by the App is for general informational purposes only and is not a substitute for professional medical advice.
3. Premium Subscriptions
No Gout offers optional Premium subscriptions that unlock additional features. By subscribing, you agree to the following:
- Billing: Subscriptions are billed through your Apple ID account via the App Store.
- Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
- Free Trial: If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription.
- Price Changes: We may change subscription prices. You will be notified in advance of any price change and your continued subscription constitutes acceptance.
- Cancellation: Cancel anytime via Settings → Apple ID → Subscriptions on your iPhone. Cancellation takes effect at the end of the current billing period.
- Refunds: Subscription payments are non-refundable except as required by applicable law. Refund requests must be directed to Apple through their standard refund process.
4. Health Disclaimer
The App's gout risk scores, purine estimates, and dietary suggestions are based on general nutritional data and AI analysis. They are approximations and may not be accurate for every individual, food preparation method, or portion size.
No Gout is not a diagnostic tool and does not replace consultation with a physician, rheumatologist, dietitian, or other licensed healthcare provider. Do not make medical decisions based solely on information provided by this App.
5. AI-Generated Content
Food analysis and purine estimates are generated using AI models. Results may contain errors or inaccuracies. Always verify important dietary decisions with reliable sources or your healthcare provider. We are not liable for any harm resulting from reliance on AI-generated content.
6. User Accounts and Data
You may create an account using email/password or Sign in with Apple. You are responsible for maintaining the confidentiality of your account credentials. Your scan history and profile data are stored locally on your device and synced to your account via Firebase when signed in. We do not sell your personal data to third parties.
7. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Post offensive, harmful, or misleading content in community features
- Attempt to reverse engineer, decompile, or tamper with the App
- Interfere with the App's servers or infrastructure
- Use the App in a way that could damage, disable, or impair our services
8. Intellectual Property
All content, design, graphics, and software in the App are the property of COZYGRAIL LLC or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
9. Limitation of Liability
To the fullest extent permitted by law, COZYGRAIL LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
10. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranty of any kind. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Continued use of the App after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
